THESE TERMS

1.1 
What these terms cover
These Terms specifically apply to any Services that I may provide to You from time to time and constitute the contract between myself in relation to the supply of the Services by me to you. These Terms are deemed effective from the date you proceed to book an Appointment, use or receive any of the Services, or pay for any of the Services (whichever is soonest).

1.2
Why you should read them.
Please read these Terms carefully before you purchase my services. These Terms tell You who am I, how I will provide Services to you, how I may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact me to discuss.

1.3
Changes to these terms
I reserve the right to alter these Terms from time to time and it is your responsibility to review the Terms before each Appointment. If you do not wish to be governed by the new version of the Terms, you must notify me and cease to use my Services.

INFORMATION ABOUT ME & HOW TO CONTACT ME

Who am I?
I am Lucy Russell, a sole trader established in England and Wales and a certified Clinical Hypnotherapist, Master NLP Practitioner, Life Coach, Yoga Teacher and Master Reiki Practitioner.

If I have to contact you, I will do so by writing to you at the email address you provided to me when you booked your Appointment.

DEFINITIONS
.

“Appointment”
shall mean a pre-agreed and confirmed date and time when I will discuss and provide the Services to you.-

“Client Intake & Consent Forms”
means the forms that you are required to complete before booking an Appointment or Services with me. These forms will ask you to provide, inter alia, your contact details and your medical history.

“CNHC”
means the Complementary & Natural Healthcare Council, which is the UK regulator for complementary healthcare practitioners.

“Contact Information” 
means Personal Information such as your name, address, phone number and email address that you provided to me for the purposes of interacting with me through the Website.

“Appointment”
shall mean a pre-agreed and confirmed date and time when I will discuss and provide the Services to you.

“Client Intake & Consent Forms”
means the forms that you are required to complete before booking an Appointment or Services with me. These forms will ask you to provide, inter alia, your contact details and your medical history.  

“CNHC”
means the Complementary & Natural Healthcare Council, which is the UK regulator for complementary healthcare practitioners.

“Contact Information” 
means Personal Information such as your name, address, phone number and email address that you provided to me for the purposes of interacting with me through the Website.

“Content”
means all text, graphics, images, video, sound and other data displayed on, or made available to You by Me.

“Price”
means the charges payable by you in respect of any Services provided by me to you in accordance with clause 8.

“Services”
refers to any hypnotherapy, neuro-linguistic programming, reiki, yoga and life coaching services and/or advice provided by me to you under these Terms, including any of the services further detailed in clause 7, whether or not such services are provided at any Appointment or otherwise.

“Terms”
shall mean the terms and conditions herein and any other terms that govern Your use of the Website, including and not limited to the Website Terms of Use  and the Privacy and Cookie Policy

“Website”
shall mean my Lucy Russell’s website at www.lucy-russell.com.

“I”, “me” or “myself”
shall be references to Lucy Russell, a sole trader established in England and Wales.

“You”, “your” or “yourself”
shall be references to any person who shall use the Services.

Standards of Behaviour

4.1
I will use best practice at all times and adhere to the standards of conduct as stated by my governing bodies.

4.2
In return of attending your Appointment you agree to the following standards of behaviour:

a.
Complete the Client Intake & Consent Forms truthfully and accurately (including medical history, contact details etc.).
b.
Provide a GP medical note when required to do so as this will allow me to decide whether I can help you.
c.
Be free from drugs and alcohol (except medication prescribed by your doctor).
d.
You undertake not to harm Yourself, or any other person, including myself or any property belonging either to me, the practice or any other person.
e.
Be committed to your treatment and treat me and with respect.
f.
If You do come to Appointments under the influence of alcohol or recreational drugs or demonstrate violent, abusive or anti-social behaviour, I reserve the right to cancel the Appointment and refuse to provide any Service to you, and the Appointment Price will be refundable in accordance with clause 11.







5.
MEDICAL DISCLAIMER & RELEASE

5.1
I aim to always act in my clients’ best interests. Therefore, please note that my Services are not suitable for those in crisis. If you are contemplating suicide or believe You are at risk of harming yourself or others please contact the emergency services in Your country (111 for UK) or go to any hospital accident & emergency department.

5.2
I am not a healthcare practitioner or provider. Any information provided through this website is for general informational purposes only and is not intended to constitute or substitute for:
a.
medical advice or counselling;
b.
the practice of medicine including but not limited to psychiatry, psychology, psychotherapy or the provision of health care diagnosis or treatment;
c.
the creation of a physician-patient or clinical relationship; or
d.
an endorsement, a recommendation or a sponsorship of any third party, product or service by us or any of our related companies, agents, employees, consultants or service providers.

5.3
If you have or suspect that you have a medical problem, contact your health care provider promptly.


5.4
You acknowledge and agree that you will consult with your doctor if you have any questions or wish to seek advice regarding a medical condition, your diet, nutritional supplements, an exercise regimen or any other matter related to your health or general well-being


5.5
You take responsibility to consult with a doctor before undertaking any of my Services (in particular, if, for example, you are taking severe medication, you are pregnant or you have severe medical conditions that require major hospital treatment and/or psychological assistance such as migraines, epilepsy, heart problems, physical pain or injury etc.) and I shall be entitled to rely on your confirmation that you have done so.


5.6 
If you have any specific questions about any medical matter, you should consult a doctor or other professional healthcare provider.


5.7 
I will always do my best to help you achieve a successful outcome to your treatment. However, you accept that an agreement to work on an issue does not mean that a particular outcome can be guaranteed. Fees are payable for your Appointments and for my time and expertise, regardless of the outcome. Results may differ from person to person.


5.8
Nothing in this clause will exclude any of my liability that may not be excluded under applicable law.

 



6
SUPPLY OF SERVICES

6.1
You must be over the age of 18 to use my Services. If you are under the age of 18, you must ask a parent or guardian to register with me and both you and your parent/guardian will be subject to these Terms.

6.2
I shall provide the Services to you in accordance with these Terms and in supplying the Services I shall:

a.
provide and perform the Services with reasonable care and skill;
b.
use reasonable endeavours to perform the Services in accordance with any description of a service, including those set out in clause 4;
c.
comply with all applicable laws, statutes, regulations from time to time in force provided that I shall not be liable under these Terms if, as a result of such compliance, I am in breach of any of my obligations under these Terms.

6.3 
I shall carry out the Services by the time or within the period set out during the online checkout process and in the confirmation email (see clause 9.3). If you and I have agreed no time or period, this will be within a reasonable time.


6.4
My carrying out of the Services might be affected by events beyond my reasonable control. If so, there might be a delay before I can restart the Services, having made reasonable efforts to limit the effect of any of those events and having kept you informed of the circumstances, but I will try to restart the Services as soon as those events have been fixed.


6.5
I shall advise you in your first Appointment of any equipment you may need (for example weights and mats). It is your responsibility to have these items as they will not be provided by me and the Price does not cover any cost or expense towards any required support or equipment.


6.6
I can offer no guarantees in relation to the suitability or effectiveness of the Services for all persons or in relation to the treatment of any specific desired outcome.


6.7
You are responsible for ensuring that you have a good internet connection, computer microphone, headphones or video camera etc. to ensure your Appointment runs smoothly.

 



7
MY SERVICES

7.1
I offer the following specified services:

a.
Free 20 minute introductory call
an initial no-cost no-obligation discovery telephone or video call (via a secured platform such as Zoom) to discuss how I can help you.

b.

One-off In-Depth Consult & Therapeutic Treatment:
a specific 1.5 hours one-off initial consult and treatment and/or an experience of how I work for new clients.

·            Please note that the One-off In Depth Consult & Therapeutic Treatment does not include time for in-depth follow up, however I shall summarise any important information relating to my recommended therapeutic approach, likely outcomes, and potential risks and benefits to the best of my knowledge via email.

c.
A Course of 6 or 12 Appointments
A package of 6 or 12 Appointments - Includes the initial consultation which is up to 1.5 hrs in length and the remaining 5 or 11 of 1 hour each. (please see clause 7.2 below for further details).

I recommend these Appointments sessions to be booked in weekly succession, however, as circumstances may not always permit, I will schedule them as closely together as possible. There may be some situations when I recommend that the Appointments to be less than/ or more than a week apart, but this will be determined and discussed on an individual basis.

Using hypnotherapy I begin by identifying the root cause of problem. I then continue to guide the process of transformation using Hypnosis, NLP, Coaching, Yoga Therapy and energy healing techniques

Appointments must be used within 6 months from the first appointment date, unless there are extenuating circumstances which can be discussed and agreed on an individual basis.

I will send you a check-in message before the next scheduled Appointment to understand how you are and address any pressing questions. Please note this is not a full consultation, if in-depth support is required, I will recommend booking another Appointment.

d.
Bespoke Packages

These are available on request and determined by the individuals needs. Price and duration to be agreed individually.


7.2
Therapeutic notes generally consist of (but not limited to):
a.
A summary of relevant insights or actions relating to the recommended therapeutic approach, likely outcomes and potential risks and benefits to the best of my knowledge.
b.
If appropriate, I shall provide supporting references, resources or inspiration to support your process. This could take the form of a personalised hypnotherapy recording, references to articles / podcasts / programs or a supporting therapeutic assignment such as a breathing practice / exercise / journaling.
c.
If applicable, recommendations for adjunct healthcare such as a Functional Doctor / Nutritionist / Naturopath / Acupuncturist to provide you with additional support and care.

PRICES & PAYMENT

8.1
The Prices for the Services shall be as follows:

Free 20 minute introductory call: Free

A Course of 6 Appointments: £895

A Course of 12 Appointments: £1595

Bespoke Packages: To be agreed individually

8.2
My prices are in pound sterling (£)


8.3
I retain the right to review and increase my Prices at any time at my own discretion, depending on any change in circumstances. I shall use reasonable endeavours to notify you if a Price increase may impact your Services.

Price changes will not affect Appointments that I have already confirmed and you have paid for.


8.4
Any Services agreed between me and you that do not fit the core Services set out in clause 5.1 above, shall be at a separate Price agreed by us and may be subject to a separate cancellation policy agreed between us from time to time.


8.5
All payments are expected to be paid in full and in advance of the Appointment or performance of Services.


8.6
If you have a friends & family code or any other discount code I make available from time to time this can be entered prior to check out by selecting ‘Discount Code’.


8.7
I accept payments made via PayPal or Stripe, both allowing payments from all major credit cards, debit cards and Apple Pay.





9
BOOKING APPOINTMENTS

9.1
All Appointment booking requests must be made via the appointments page on the Website Appointments Page, unless agreed otherwise by Us.



9.2
To book an Appointment you will need to take the following steps:
a.
Chose the Service that You need.

b.
Then,
i.
If you are a new client, you must book via the ‘New Client’ section in order to complete the Client Intake & Consent Forms.
ii.
If you are an existing client, you may go straight to ‘Existing Client’. You also have the option of setting up an account which will contain your previous history for prompt booking.

c.
For the “Free 20min Introductory Call”, please follow these steps:
(i) Click “Apply for Call” button;
(ii) Complete Client Intake & Consent Forms;
(iii) Await confirmation email. This will either (1) accept application with a scheduling link to book a call; or (2) decline the request for call with reasons; and
(iv)Schedule the call via the Website link.

d.
Fill in your contact details.
e.
Select your preferred appointment date/time.
f.
pay the Price.

 

9.3
You will receive a confirmation of your Appointment via email. This will include confirmation of your payment and appointment time, as well as address details if your Appointment will be in person or Zoom log in details if your Appointment will be online.
9.4
You are responsible of and must ensure that your details as entered onto the Appointments Page are complete and accurate before you submit a booking for an Appointment. If you think that there is a mistake or changes are required to this information, please contact me immediately.
9.5
When you submit a request to book an Appointment to me, this does not mean that your Appointment is accepted. My acceptance of any Appointment will take place when you receive an acknowledgement and confirmation from me as described at clause 9.3 above. If I am unable to complete your booking, I will communicate this to you and I will not book the Appointment.
9.6
You will receive a reminder via email the day before your Appointment.





10.
YOUR RIGHTS TO RESCHEDULE OR CANCEL YOUR APPOINTMENT

10.1
If you need to cancel or reschedule your Appointment, then please contact me via email at enquire@lucy-russell.com at least 72 hours in advance of your Appointment. 
10.2
If I am able to reschedule your Appointment then I will do so, otherwise your right to a refund for any Services shall be as set out below:
a.
Cancellations made within or more than 72 hours before the Appointment will be refunded back to you in full.
b.
Cancellations made within in less than 72 hours, but more than 24 hours before the Appointment will be refunded at 50% of the Price you paid.
c.
Cancellations made within or less than 24 hours before the Appointment will be non-refundable, unless there is an emergency circumstance. If there are emergency circumstances, we shall discuss them together in order to reach an individual agreement.
d.
A forgotten/no-show Appointment will be non-refundable.







11
MY RIGHT TO CANCEL OR RESCHEDULE AN APPOINTMENT
11.1
Notwithstanding my rights to cancel any of the Services in accordance with clause 11.3, I may cancel or reschedule an Appointment:

a.
where I have not received your payment of the Price in accordance with clause 8
b.
due to an event outside my control that prevents me from performing my obligations under these Terms and/or means that I cannot fulfil your Appointment; or
c.
due to the unavailability of the relevant time slot.

11.2
  I will not be held liable in these circumstances, but I may (at my sole discretion) opt to rebook your Appointment to a convenient alternative time or, where no alternative is possible, then if you have paid for those Services which are subsequently cancelled, I will refund any sums due in full.
11.3
  I reserve the right to refuse or stop providing Services to anyone for any reason where in my reasonable opinion I deem it is necessary and/or appropriate to do so. Any refunds offered in respect of the Price where I exercise my rights under this clause shall be at my absolute discretion.
11.4
I do not warrant or guarantee that all Services listed or advertised may be available at all times. I reserve the right to withdraw or amend any Services listed on the Website (I will notify you promptly and ahead of your Appointment wherever possible should these changes impact you).
11.5
If you fail to attend an Appointment for any reason, then I reserve the right to refuse to book another Appointment in the future.
11.6
Notwithstanding my rights to cancel any of the Services in accordance with clause 11.3, if I have to cancel an Appointment, I will promptly contact you to inform You and any payment you have made for Services that have not been provided will be refunded to you. Where You have booked a course of Appointments or a plan and would like to cancel the Services before the end of your package or plan, then I will reserve the right to decide at my sole discretion whether to refund any proportion of the Price you paid for the relevant Service as this will depend on individual circumstances.
11.7
  If my supply of the Services is delayed by an event outside my control then I will contact you as soon as possible to let you know and I will take steps to minimise the effect of the delay. Provided I do this I will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact me to cancel any booked Appointments and receive a refund for any Services you have paid for but not received.

LIMIT ON MY RESPONSIBILITY TO YOU

12.1
My liability to you shall be limited as set out in this clause 12.
12.2
I limit my liability under these Terms to the fullest extent permitted by law and to the extent that I am not able to exclude my liability to you in accordance with the applicable law, you agree that your sole remedy under these Terms shall be the re-performance of the relevant Services, or a full refund of the Price.

12.3
I will not be liable for any loss or damage (in contract or otherwise) where:
a.
there is no breach of a legal duty of care owed to you by me;
b.
loss or damage is not a reasonably foreseeable result of any such breach; or
c.
any loss or damage or increased risk of loss or damage results from a breach or non-compliance by you of these Terms including but not limited to these Terms such as you providing inaccurate or incomplete information.

12.4
I am not liable for:
a.
any loss of income or anticipated profits;
b.
any loss of opportunity;
c.
loss of or damage to goodwill;
d.
losses suffered by third parties; or
e.
any indirect, consequential, special or exemplary damages arising from the use of the Services, regardless of the form of action.

12.5
I shall not be liable in respect of anything which is caused by your deliberate default.
12.6
I only supply the Services to you for domestic and private use. If you use the Services for any commercial, business or re-sale purpose my liability to you will be limited as set out in this clause 12.
12.7
  Nothing in these Terms excludes or limits my liability for death or personal injury caused by my negligence or for fraud or fraudulent misrepresentation. Nothing in these Terms affects your statutory rights.




 13.
CLIENTS OUTSIDE THE UK

For clients outside the UK, please note that the relevant authorities / overseeing bodies in your country may not directly recognise the types of Services I offer. I hold the certification required to provide my Services as recognised within the UK. For this reason and for all aspects, only UK standard and codes of practices are applicable. You are responsible to ensure that you use my Services in accordance with the applicable laws and regulations in your country.

YOUR PRIVACY & PERSONAL INFORMATION

My Privacy Policy is available at

your privacy and personal information are important to me. Any personal information that you provide to me will be dealt with strict confidentiality and in line with my Privacy Policy, which explains what personal information I collect from you, how and why I collect, store, use and share such information, your rights in relation to your personal information and how to contact me and supervisory authorities if you have a query or complaint about the use of your personal information.

LICENCE & INTELLECTUAL PROPERTY RIGHTS

15.1
The copyright and other intellectual property rights in the Content (including without limitations photographs and graphical images) are owned by me or my licensors.
15.2
Any redistribution or reproduction of part or all of the Content in any form is prohibited other than you may print or download to a local hard disk extracts for your personal and non-commercial use only.
15.3
You may not, except without my express written permission, distribute or commercially exploit the Content. Nor may you transmit it or store it in any other Website or other form of electronic retrieval system.
15.4
  Any rights not expressly granted in these Terms are reserved to me.



16
COMPLAINTS

16.1
I sincerely hope that you will be happy with my Services. However, if you do have any complaints regarding the Services I provide, then please contact me at enquire@lucy-russell.com.
16.2
Complaints must include the date and location of the incident, the full name of the complainant, details of the complaint and a desired outcome following the complaint.
16.3
All complaints will be taken very seriously and a response will be provided within 30 days.

You have the right to refer any unresolved complaint to CNHC by writing to them at info@cnhc.org.uk


17
TERMINATION


17.1
  I reserve the right to terminate this agreement at any time in the event that in my opinion you are not likely to benefit from ongoing treatment with me by giving you one week’ notice of termination.


17.2
Without limiting any other rights or remedies, I may terminate the agreement with immediate effect by providing written notice to you, if you breach any of the provisions set out in these Terms.


17.3
You may terminate this agreement by notifying me at enquire@lucy-russell.com provided you give 2 weeks written notice. The notification will not be effective until I have received it and provided confirmation of receipt to you.

 

18
OTHER IMPORTANT ITEMS


18.1
These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.


18.2
These Terms constitute the entire agreement between us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.


18.3
Each party acknowledges that in entering into these Terms it does not rely on and shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these Terms.


18.4
If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause 18 shall not affect the validity and enforceability of the rest of these Terms.


18.5
  A waiver of any right or remedy under these Terms or by law is only effective if given in writing and shall not be deemed a waiver of any subsequent right or remedy. A failure or delay by a party to exercise any right or remedy provided under these Terms or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under these Terms or by law shall prevent or restrict the further exercise of that or any other right or remedy.

JURISDICTION & APPLICABLE LAW

19.1
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by, and construed in accordance with the law of England and Wales.


19.2
  Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or its subject matter or formation.
